Acceptance of Terms By accessing or using the website https://muckeen.com (the "Service") provided by Muckeen.com ("Muckeen", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. 2. Eligibility You must be at least 16 years old to use Muckeen. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding contract under Irish law. 3. Description of Service Muckeen is an aggregation and leaderboard platform. We allow you to connect your third-party fitness accounts (such as Garmin Connect and Apple Health) to import your activity data, generate personal insights, and compete on public leaderboards based on your athletic performance. 4. Leaderboards and Public Display By choosing to participate in Muckeen’s leaderboards, you acknowledge and agree that: Public Visibility: Your chosen display name, profile picture, and relevant activity metrics (e.g., distance, elevation, pace, time) will be publicly visible to other users of the Service. Opting Out: If you no longer wish to have your data displayed publicly, you may leave the leaderboards or disconnect your third-party accounts at any time via your account settings. 5. Fair Play and Code of Conduct Muckeen is built on friendly, honest competition. To maintain the integrity of our leaderboards, you agree to the following rules of Fair Play: Accuracy: You will not manually alter, fabricate, or spoof GPS/activity data to artificially inflate your standing on a leaderboard. Appropriate Categorization: You will accurately categorize your activities (e.g., do not log an e-bike ride or a motorcycle trip as a manual cycling activity or run). Respect: You will not use offensive, defamatory, or inappropriate language in your display name or profile. Enforcement: Muckeen reserves the right, at our sole discretion, to flag, hide, or permanently delete any activity data that we suspect is inaccurate, fabricated, or miscategorized. We may suspend or terminate accounts that repeatedly violate these Fair Play rules without notice. 6. Assumption of Risk (Important) Muckeen provides data aggregation, not medical or coaching advice. By using the Service, you acknowledge that sports and physical activities carry inherent risks. Know Your Limits: You agree that you are solely responsible for your own health and safety. You should not overexert yourself, ignore medical advice, or take dangerous physical risks in an attempt to improve your standing on a Muckeen leaderboard. No Medical Advice: Nothing stated or posted on the Service is intended to be, and must not be taken to be, the practice of medical or professional fitness counseling. 7. Limitation of Liability To the maximum extent permitted by Irish law, Muckeen, its founders, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from: Any physical injury, health issue, or property damage incurred before, during, or after an activity tracked and synced to the Service. Any unauthorized access to or use of our secure servers and/or any personal information stored therein. Any bugs, viruses, or interruptions in the Service. Any actions taken by third-party APIs (Garmin, Apple) including the revoking of access or changes to their data structures. 8. Intellectual Property Your Data: You retain all ownership rights to your personal activity data. By connecting your accounts, you grant Muckeen a non-exclusive, royalty-free license to fetch, display, and format this data solely to operate the Service. Our Platform: The Muckeen brand, website design, code, logos, and aggregated, non-personally identifiable site data are the exclusive property of Muckeen. Third Parties: Garmin, Apple, and other third-party trademarks are the property of their respective owners. Muckeen is an independent developer and is not officially affiliated with, endorsed by, or sponsored by Garmin or Apple. 9. Privacy Your privacy is fundamentally important to us. Please review our Privacy Policy at https://muckeen.com to understand how we collect, use, and protect your data, specifically regarding our strict adherence to Garmin and Apple API requirements. 10. Termination You may terminate this agreement at any time by deleting your Muckeen account. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you breach these Terms. 11. Governing Law and Jurisdiction These Terms shall be governed by and construed in accordance with the laws of the Republic of Ireland. You agree that the courts of Ireland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or your use of Muckeen. 12. Changes to Terms We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting an update on our website or sending an email to registered users. Continued use of the Service after any changes constitutes your acceptance of the new Terms. 13.
